These Terms & Conditions (“Terms”) govern your use of the Fictionary mobile application (“the app”, “Fictionary”). By downloading, accessing, or using the app, you agree to these Terms. If you do not agree, please do not use the app.
1. Licence
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use Fictionary for your own non-commercial entertainment on any Apple device that you own or control, as permitted by the Apple App Store Terms of Service. You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works from the app except as allowed by law.
2. Eligibility
You must be old enough to use the app under the laws of your country and to agree to these Terms. The game may include mild or crude humour and user-created content; it is intended for a teen and older audience.
3. Acceptable use & user-generated content
Fictionary is a multiplayer game in which players type free-text answers (“bluffs”) that are shown to other players in the same room. You are solely responsible for the content you submit.
You agree that you will not submit content that is unlawful, hateful, harassing, threatening, defamatory, obscene, sexually explicit, that contains slurs or promotes violence or discrimination, or that infringes anyone’s rights.
Zero tolerance for objectionable content and abusive behaviour. There is no tolerance for objectionable content or abusive users. The app filters submitted answers for objectionable content and lets any player report and hide an answer they find objectionable. We may remove content and restrict or remove a user’s access to a game. A game host may end a game for all participants at any time.
Because multiplayer rooms are private and temporary, content is shown only to the players in your room and is not stored after the round ends (see the Privacy Policy).
4. In-app purchases
Fictionary offers an optional one-time in-app purchase, “Fictionary Premium,” which unlocks premium game modes. All purchases are processed by Apple through the App Store and are subject to Apple’s terms. Prices are shown in the app before purchase. Purchases are generally non-refundable except as required by law or under Apple’s refund policies. Refund requests are handled by Apple, not by us. Premium modes can also be unlocked without payment by earning in-app XP through play. In-app XP and unlocks have no cash value and are stored only on your device.
5. Intellectual property
The app, its name, logo, artwork, prompt content, and design are owned by us or our licensors and are protected by intellectual-property laws. Fictionary is an original game and is not affiliated with, endorsed by, or connected to any other game or brand.
6. Availability & changes
We may update, change, suspend, or discontinue the app or its multiplayer service at any time, including for maintenance. The multiplayer service holds game state in memory only, so in-progress games may end if the service restarts. We do not guarantee uninterrupted or error-free operation.
7. Disclaimer of warranties
The app is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement, to the fullest extent permitted by law.
8. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of or inability to use the app. Nothing in these Terms limits liability that cannot be limited under applicable law.
9. Third-party terms
Your use of the app is also subject to the Apple Licensed Application End User Licence Agreement (EULA). Where these Terms and Apple’s EULA conflict, Apple’s EULA governs to the extent required. Apple is not a party to these Terms and is not responsible for the app or its content.
10. Governing law
These Terms are governed by the laws of England and Wales, without regard to conflict-of-law rules, unless a mandatory law of your country of residence provides otherwise.
11. Changes to these Terms
We may update these Terms from time to time. Changes take effect when posted at this URL, with an updated date at the top. Continued use of the app after changes means you accept the revised Terms.
